Acceptance of Terms

By accessing or using TrueRadium's services, facilities, or website, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

These terms constitute a legally binding agreement between you and TrueRadium B.V., a company registered in the Netherlands with registration number NL72819364, located at Eikenlaan 56, 4853 PC Breda, North Brabant.

Description of Services

TrueRadium provides fitness and wellness services including but not limited to:

• Personal training sessions
• Group fitness classes
• Strength training programmes
• Fitness assessments and consultations
• Nutrition guidance
• Access to fitness facilities and equipment

Membership and Registration

To use our services, you must:

• Be at least 18 years of age or have parental consent
• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorised use of your account
• Complete any required health and fitness assessments

User Obligations

As a user of TrueRadium services, you agree to:

• Follow all facility rules and safety guidelines
• Treat staff, trainers, and other members with respect
• Use equipment properly and responsibly
• Maintain appropriate hygiene and dress standards
• Arrive on time for scheduled appointments and classes
• Provide advance notice for cancellations according to our policy
• Pay all fees and charges in a timely manner
• Not engage in any disruptive or inappropriate behaviour
• Disclose any relevant health conditions or limitations

Health and Safety

Your health and safety are paramount. You acknowledge and agree that:

• Physical exercise involves inherent risks
• You participate in activities at your own risk
• You should consult a physician before beginning any exercise programme
• You must disclose any health conditions that may affect your ability to exercise safely
• You will follow all safety instructions provided by our staff
• You will not use equipment or facilities if you are under the influence of alcohol or drugs

Payment Terms

Payment terms for TrueRadium services:

• All fees must be paid in advance unless otherwise agreed
• Membership fees are non-refundable except as required by law
• We reserve the right to change prices with reasonable notice
• Late payment may result in suspension of services
• All prices are inclusive of applicable taxes

Cancellation Policy

Our cancellation policy includes:

• Personal training sessions require 24 hours' notice for cancellation
• Group classes require 2 hours' notice for cancellation
• Late cancellations may result in charges
• Membership cancellations must be provided in writing with appropriate notice period
• Some services may have specific cancellation terms outlined in separate agreements

Intellectual Property

All content on our website and in our facilities, including but not limited to text, graphics, logos, images, software, and training programmes, is the property of TrueRadium or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any of our proprietary content without express written permission. Our training methods, programmes, and materials are confidential and proprietary to TrueRadium.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by law, TrueRadium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability for any claims arising from these terms or your use of our services shall not exceed the amount you have paid to TrueRadium in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless TrueRadium, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, violation of these terms, or violation of any rights of another party.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer residing in the European Union, you may have additional rights under local consumer protection laws, and nothing in these terms shall limit such rights.

Dispute Resolution

We encourage you to contact us directly to resolve any disputes. If a dispute cannot be resolved through direct communication, we may seek resolution through mediation before pursuing litigation.

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for any reason including but not limited to:

• Violation of these terms of service
• Inappropriate or disruptive behaviour
• Non-payment of fees
• Safety concerns
• Fraudulent activity

Upon termination, your right to use our services will cease immediately, and you must return any materials or equipment belonging to TrueRadium.

Force Majeure

TrueRadium shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, or other emergencies that may require temporary closure of facilities.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

Entire Agreement

These terms, together with our Privacy Policy and any additional service-specific agreements, constitute the entire agreement between you and TrueRadium regarding your use of our services and supersede all prior agreements and understandings.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new terms.
